If you are a resident outside Japan, you may probably not know that on
December 6th last year (1998), a prominent crown lawyer of Japan, Mr. Yasuda
Yoshihiro was arrested by the police for a trifle regarding bad credits
i.e. credits difficult for creditors to withdraw.
Mr.Yasuda is known not only for being one of the most eminent criminal
lawyers but also for the leader of anti-death penalty movement in Japan.
Moreover, he was in the position of chief counsel of the public defenders
for the guru (relogious leader) of Aum Shinrikyo (Aum Supreme Truth), a
religious sect or a cult which is reported to have committed Japan-shaking
crimes succesively.
This case is an epoch-making one for the Police Power of Japan, behind which
a big problem lies ; problem of fascistization of whole Japan. In order to
let world people know that, I’ve decided to write this analysis.
Reason for the arrest of the lawyer
Mr. Yasuda was a legal adviser to a corporation whose nationality was
Singapole and it was not able to repay banks the money it borrowed. The
corporation also did not repay the money to Jukan (National organization of
management of the credits of housing loan companies) which succeeded to the
credits or obligatory rights. The police insist that it was the lawyer,
Yasuda who recommended the company to hide its property in order not to
repay the money to Jukan. I will explain later that what the police claims
is unreasonable.
First, please note that the criminal investigation section 2 of Tokyo
Metropolitan Police Headquarters executed the apprehention.
Regarding the change in the Police Force of Japan
The mainstream of the Police organization has been the security police. The
chronological list of the heads of the National Police Agency and Tokyo
Metropolitan Police Headquarters shows that their roots were not the
criminal police but the security police.

The main aim of the police has not changed still now. organizations till then, lost sight of their enemies or targets.
On the other hand, the criminal police have competence of authorization orgrantinglisence
to companies. The criminal police are acquisitive of getting moneyand interests,making
full use of its right or competency.
The opportunity for the criminal police to be dominant was the terrorism byAumShinrikyo.
The method adopted by the security police was of no use ininvestigatingAum’s cases,
though it had long been effective and useful before.
The objective of investigation for the security police is to give the entirepicture
of the“criminal” organization, and accordingly, they must let a suspected person“swim”
freeeven when they can easily capture the person. On the contrary, the criminalpoliceusually
arrest a suspect at the moment of finding him. And with physicalrestraint, theyundergo
the examination of him in order to lead him to making a fullconfession of his crime.
The criminal police method is more suited to the crimes nowadays, as afterleft-wingersor
leftist organizations have almost died off, crimes are more momentary andinstantaneous.
It has become more effective for the maintenance of publicorder than the one of the
security police.
